Medical Marijuana History in DC
Amendment Act B18-622, entitled “Legalization of Marijuana for Medical Treatment Act of 2010,” was approved unanimously by the Council of the District of Columbia on May 4, 2010, and signed by the City Mayor on May 21, 2010. The law, as approved and signed by the Mayor, underwent a 30-day Congressional review and since neither the Senate nor the House of Representatives stopped the law, it became effective on July 27, 2010.
On April 14, 2011, an emergency amendment to the DC Municipal Regulations was announced by Mayor Vincent Gray which added a new Sub-Title “Medical Marijuana.” This amendment established the process and procedures for patients, caregivers, physicians, and dispensaries and set-forth the provisions in which the Department of Health administers the Medical Marijuana Program.
Registration of the qualifying patients and caregivers in the Program is mandatory and, as part of the registration process, the qualifying patient is required to designate on his application the dispensary from which he will receive and/or acquire medical marijuana.
Qualifying patients and designated caregivers may only obtain medical marijuana from the dispensary designated on their respective registration identification cards. Neither patients nor caregivers are allowed to grow or cultivate medical marijuana. The law also prohibits them from purchasing and obtaining medical marijuana from vendors or from other patients and caregivers.
